Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and BookSculpt ("BookSculpt", "we", "us"). By creating an account, accessing, or using booksculpt.pro or any related services (the "Service"), you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" will refer to that organization.

2. Description of the Service

BookSculpt provides tools for writing, editing, formatting, collaborating on, and publishing books, including AI-assisted writing features, manuscript import/export, real-time collaboration, cover-design helpers, and integrations with third-party publishing platforms (including Amazon Kindle Direct Publishing). We may add, remove, or modify features at our discretion.

3. Eligibility and Account Registration

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. You agree to provide accurate and complete registration information and to keep it up to date.

You are responsible for all activity on your account and for maintaining the confidentiality of your credentials. Notify us at support@booksculpt.pro immediately of any unauthorized access.

4. Subscription, Billing, and Refunds

Paid plans (Light, Standard, Pro) are billed in advance on a monthly or annual basis through our payment processor, Stripe. All fees are in U.S. dollars unless otherwise stated and are exclusive of applicable taxes.

Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled at least 24 hours before renewal.

Cancellation: You may cancel at any time from your Settings page. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds: We offer a 14-day refund window for first-time paid subscriptions. After 14 days, fees are non-refundable except where required by law. Contact support@booksculpt.pro to request a refund.

Free plan: The free plan is offered as-is and may be modified or discontinued at any time.

5. Your Content and Ownership

You retain all intellectual property rights in the manuscripts, outlines, notes, cover images, and other content you create or upload ("Your Content"). You are solely responsible for Your Content.

You grant BookSculpt a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (only for the purposes of rendering, formatting, and delivering the Service to you), and transmit Your Content. This licence ends when you delete Your Content or close your account, except where we are required to retain it by law.

We will not sell, publish, or disclose Your Content to third parties except as described in our Privacy Policy or as required to operate the Service.

6. AI-Assisted Output

BookSculpt integrates third-party large language models (including Anthropic Claude via Emergent Integrations) to generate text suggestions, cover briefs, and marketing content ("AI Output"). You own the AI Output produced from your prompts, subject to the upstream provider's terms.

AI Output is provided as a writing aid and may contain inaccuracies, biases, or material that resembles existing works. You are solely responsible for reviewing, editing, fact-checking, and clearing any rights before publishing AI Output. BookSculpt makes no warranty that AI Output is accurate, original, non-infringing, or suitable for any particular purpose.

7. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

  • infringes the intellectual property, privacy, or publicity rights of others;
  • is unlawful, defamatory, harassing, abusive, or threatens violence;
  • constitutes child sexual abuse material (CSAM) — we report all detected CSAM to appropriate authorities;
  • contains malware, tracks users without consent, or compromises Service security;
  • attempts to reverse-engineer, scrape, or resell the Service;
  • impersonates another person or entity, or misrepresents your affiliation;
  • violates applicable export controls or sanctions laws.

We reserve the right to suspend or terminate accounts that violate this policy, with or without notice, at our sole discretion.

8. Third-Party Services

The Service integrates with third-party platforms (e.g., Amazon KDP, Stripe, Resend, Google OAuth). Use of those services is subject to their respective terms, and we are not responsible for their availability, accuracy, or practices.

9. DMCA and Copyright Complaints

If you believe material on BookSculpt infringes your copyright, send a DMCA notice to dmca@booksculpt.pro containing: (1) a description of the copyrighted work; (2) the location of the allegedly infringing material on BookSculpt; (3) your contact information; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that the information is accurate; (6) your physical or electronic signature.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKSCULPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless BookSculpt and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms.

13. Termination

You may terminate your account at any time from Settings or by contacting support. We may suspend or terminate your account for violation of these Terms, non-payment, or inactivity. Upon termination, Your Content may be deleted after a reasonable retention period. Sections that by their nature should survive termination (ownership, disclaimers, limits, indemnification, governing law) shall survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules, in English, in Wilmington, Delaware. You and BookSculpt waive the right to trial by jury or to participate in a class action. Small-claims court actions are excluded from this arbitration agreement.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
